These Terms apply to services requested from OnPoint Fixer, a trading name of Code Fact Solutions Ltd. They explain the basis on which we receive, source, coordinate, arrange or provide services. Please read them before confirming a booking or paying a fee.
OnPoint Fixer is a rapid-response sourcing and coordination service for urgent, unusual or time-sensitive requirements. Requests may include property repairs and trades, cleaning and clearance, couriers and transport, last-minute staffing, IT support, security-related support, property or business emergencies, confidential requests and other bespoke requirements.
We may provide elements of a service ourselves, arrange a service, or introduce an independent third-party provider. We will aim to make the nature of our role clear for the particular request.
Submitting an enquiry does not guarantee acceptance, provider availability, attendance or completion within a particular time. A contract arises only when we confirm that we have accepted the request or booking, or otherwise clearly agree to provide the service.
We may refuse requests that are unlawful, unsafe, inappropriate, outside our capabilities or where a suitable provider cannot reasonably be sourced.
Where reasonably possible, we will provide a price, estimate or charging basis before chargeable work begins. Some urgent or diagnostic work cannot be accurately priced until the situation has been assessed.
Additional work, materials, parts, parking, tolls, congestion charges, specialist equipment or other reasonable costs may be chargeable. Where reasonably practicable, material additional costs will be explained and approved before they are incurred.
Certain requests may require a commitment, sourcing, booking, coordination or call-out fee before we begin work, source a provider or arrange attendance. The amount and purpose of the fee will be communicated before payment.
A fee is not automatically non-refundable in every circumstance. If a booking is cancelled after chargeable sourcing, coordination or dispatch work has taken place, we may retain or charge a reasonable amount reflecting services supplied and costs or losses properly incurred, where permitted by law.
Some work is carried out by independent contractors, tradespeople, couriers, professionals or other third-party businesses. Their identity and contractual role may vary according to the booking.
Where the customer’s contract for the underlying work is directly with an independent provider, that provider is responsible for performing its contractual obligations. Where OnPoint Fixer itself is legally responsible for a service, nothing in these Terms removes that responsibility or any statutory rights the customer has.
We aim to respond quickly but estimated response and arrival times are not guaranteed unless expressly agreed. Traffic, weather, provider availability, access, supply of parts and circumstances outside our reasonable control may affect performance.
OnPoint Fixer is not an emergency service. If there is an immediate risk to life, serious injury, fire, crime in progress, gas emergency or another situation requiring a statutory emergency service, contact the appropriate emergency service or authority.
Tell us as soon as possible if you wish to cancel. Any cancellation charge will be reasonable and will take account of the circumstances and work or costs already incurred.
Consumers entering contracts at a distance may have statutory cancellation rights. Where you expressly ask for an urgent service to begin during an applicable cancellation period, you may be required to pay a proportionate amount for services supplied before cancellation, where the law permits. Nothing in these Terms removes statutory cancellation rights.
Where consumer law applies and OnPoint Fixer is responsible for supplying a service, we will provide that service with reasonable care and skill. If something goes wrong, contact us promptly and give us a reasonable opportunity to investigate.
Depending on the circumstances, an appropriate remedy may include further investigation, remedial work, liaison with a provider, a price adjustment or refund. Statutory rights are unaffected.
We will treat confidential requests with appropriate discretion and process personal information in accordance with our Privacy Policy. We will not accept instructions requiring unlawful concealment, deception, harassment, discrimination, fraud or other illegal activity
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or rights that cannot legally be excluded.
We are not responsible for loss caused solely by inaccurate or incomplete information supplied by the customer, unauthorised instructions, or events outside our reasonable control. Any responsibility relating to an independent provider will depend on the contractual arrangement and applicable law.
Payment terms will be communicated for the relevant request. You must pay valid invoices and agreed charges by the stated due date. Where a third-party provider contracts directly with you, that provider may have separate payment terms.
Complaints should be made using the contact details published on the OnPoint Fixer website. We will handle complaints in accordance with our Complaints Policy. Making a complaint does not affect any statutory or legal rights.
We process personal information in accordance with the OnPoint Fixer Privacy Policy. Relevant information may be shared with service providers where reasonably necessary to assess, arrange or fulfil a request.
We may update these Terms for future bookings. The terms applying to a particular booking will normally be those made available when that booking was agreed, unless a change is required by law or expressly agreed.
These Terms are governed by the laws of England and Wales. If you are a consumer, nothing in this clause deprives you of any mandatory rights you have concerning applicable law or where proceedings may be brought.
